    POA Disclosure Packet Notice under revision

    The Common Interest Community Board wants to hear from you! 

     

    The Property Owners’ Association Act requires that associations provide potential purchasers with a “disclosure packet.” Because these informational documents can be quite lengthy and complex, they must be accompanied by a cover sheet developed by the Common Interest Community Board. 

    The purpose of the notice is to “summarize the unique characteristics of property owners’ associations generally” as well as to alert buyers to the “unusual and material circumstances” facing lot owners in POAs. 

    The POA DISCLOSURE PACKET NOTICE will change effective July 1st, as a result of legislation enacted during the 2017 General Assembly Session. As a result, the Board is revising the form to incorporate the statutory amendments, and also to make other improvements so that the notice conforms to other areas of state law that have changed over the years. 

    At its meeting on March 13, 2017, the Board discussed proposed amendments to the cover sheet and voted to solicit public comment on the form revisions. The draft changes are available to review here (pdf). The Board will consider the proposed draft, along with any public comments received, at its next meeting on June 8, 2017. 

    In order to be considered, please submit comments on the proposed revisions no later than 5:00 p.m. on Monday, May 29, 2017. Submit comments by ONE of the following methods to the attention of:
