EXECUTIVE ORDER 15

Shortly after Governor George Allen took office, he began to fulfill his promise to reduce the size and cost of government by signing Executive Order 15 (EO15). This Order requires every state agency that promulgates regulations to review those regulations to ensure that each one is necessary for public protection and is the least burdensome on the individuals regulated. This is going to be a large undertaking for a board such as APELSLA with the number of regulations we currently have.

There will be a multi-step process wherein DPOR staff, the Board for Professional and Occupational Regulation, public interest groups, and the regulated population will be invited to carefully review each regulation to make sure it meets the tests given above. Any current regulation not meeting the tests will be removed from regulations. Any new regulation will have to meet the same requirements.

How will this affect you? Obviously, any change in the regulations will have some impact on the people following those regulations. But you may also be asked to assist in the review process or you can volunteer your assistance. Every attempt will be made to simplify the language of the regulations wherever possible.

Since the disciplines regulated by the APELSLA Board directly influence the safety and well-being of the citizens of Virginia, it will be important that your regulations maintain their integrity throughout

this process. Your input will (see EO15, PAGE 2)

CERTIFICATION FEE

Beginning January 1, 1995, there will be a new fee implemented for providing certifications of licensure or certification for Virginia regulants applying for licensure or certification in another jurisdiction. The fee will be $25.00 and must be received before the letter of certification will be provided. Although this fee is new in Virginia, it is in keeping with the charges made by several other states.

When applying to another jurisdiction to take an examination or to be licensed by comity, be sure to find out whether you or the other state will be sending the request for certification to Virginia. This could avoid your being charged for two letters of certification.

The board policy that letters of certification will be sent directly to the requesting jurisdiction only and not to the individual remains unchanged. Δ

REVISED DIMENSIONS FORMAT

You have probably noticed that your Dimensions looks different from previous issues. By removing some of the wasted space and pictures, printing the newsletter in the Department, and making a few other changes, we are able to provide information of interest to all sections in fewer pages, thereby lowering the per issue cost in printing and mailing. Let us know your opinion of the revised format so we can make any necessary changes in future editions. Δ

The review of the regulations of the APELSLA Board will begin in July of 1995 and will culminate in a report to the Governor by July 1, 1996. If you would like to be part of this process, please call or write the APELSLA Board to request the relevant materials. Δ

NEW AGENCY LEADERSHIP

The Department of Professional and Occupational Regulation has a new Director and Chief Deputy Director. Ray Allen, Jr. was appointed Director of the agency on April 11, 1994. From 1989 until his appointment by Governor Allen, Mr. Allen was a political and legislative consultant for various office-holders and candidates in the Commonwealth. Mr. Allen's work included several positions with Delegate Kirk Cox in Colonial Heights, Congressman Tom Bliley, and President George Bush. Most recently, Mr. Allen served as the Organizational Director and Senior Staff Member of Congressman George Allen's successful candidacy for Governor. In November, Governor-elect Allen appointed Ray Allen, Jr. to his transition team in the personnel section, and in April, Governor Allen appointed Ray Allen, Jr. Director of the Department of Professional and Occupational Regulation.

Jack E. Kotvas serves as the Chief Deputy Director. As such, he serves as chief executive of the agency in the absence of the Director and provides legal consultation to the Director. He is responsible for the activities of the Regulatory Programs Division in providing support to the eighteen regulatory boards served by the agency. He is also responsible for the Records Management Division, as well as coordinating the legislative package of the agency. His other duties include providing general guidance to the Information Systems Division, providing supervision to the agency's public relations (see LEADERSHIP, PAGE 3)

BOARD CHANGES

We have five new board members this year. The newest appointee to the Architect Section is Kathryn Tyler Prigmore, AIA. She was also recently appointed to serve on the NCARB Architects Registration Exam Committee to assist with the development of Divisions G and H of the 1995 ARE. Ms. Prigmore received a B.S. in Building Sciences in 1977, a Bachelor of Architecture degree in 1978 from Rensselaer Polytechnic Institute, and her M.S. in Engineering from The Catholic University of America in 1981. A licensed architect in Virginia since 1982, Ms. Prigmore practiced architecture until 1992. Currently she serves as Associate Dean of the School of Architecture and Planning, Howard University, and as Associate Professor of Architecture.

David F. Rice, Jr. was appointed to the Land Surveyor Section. Previously, he has held offices in the American Congress on Surveying and Mapping and the International Society of Mine Surveyors. Mr. Rice graduated from The Virginia Military Institute in 1953 with a degree in civil engineering. He was licensed as a land surveyor in Virginia in 1965. In 1986, Mr. Rice, with his son, David F. Rice, III, founded Rice Associates as a land surveying firm. Today, Rice Associates provides engineering, land surveying, and land planning services to the Northern Virginia area.

Janet N. Daniels has joined the Professional Engineer Section. Ms. Daniels received a B.A. degree in Liberal Arts with a math concentration from Fairfield University and a B.S. in Civil Engineering from the University of Connecticut with a concentration in structural engineering in 1984. She practiced structural engineering in Connecticut and in Virginia and is currently president of Daniels & Giles, P.C. in Richmond.

The new appointees for the Interior Design section are Sara L. Cowherd and Lou Barnett Horne. Ms. Cowherd and Ms. Horne will be profiled in the next edition of Dimensions. Δ

Mr. Kotvas has a Juris Doctorate from the University of Richmond and a Bachelor of Science in Business Administration from the University of Pittsburgh. He has also pursued graduate studies in Administration and Human Resources. Prior to law school, he worked for a number of years in corporate management before establishing and developing a successful business. He is a member of the American Bar Association and the Virginia State Bar. Mr. Kotvas spent time in private law practice and recently has served as a faculty member at Regent University teaching legal writing and research courses in the School of Law. Δ

DISCIPLINARY ACTIONS

File Number 93-01961, Charles G. Snead, LA.

Violation - Mr. Snead submitted a sealed set of group "A" building plans without being licensed as an architect. Board Action - $750 monetary penalty. Regulations - (1992) §54.1-406.A&B, and 11.5.A. Effective - February 4, 1994

File Number 93-02027, William E. Ramsey, LS

Violation - Mr. Ramsey prepared a house location survey based on another person's work. There was no notification to the original licensee that his work was being used. Board Action - $100 monetary penalty. Regulations - (1991) 10.6 and (1992) 11.6 Effective - February 4, 1994

File Number 93-00700, Edward S. Papa, PE

Violation - Mr. Papa issued certifications on water heater control devices when living in another state and not exercising control over the work performed. Board Action - $1000 monetary penalty. Surrender of license and agree to not apply for licensure for five years from the effective date of the order. Regulations - (1992) 11.5.B and 11.8.A.B.1 Effective - March 10, 1994

Violation - Mr. Elrefai failed to register his company with the board as required by law. Board Action - $500 monetary penalty and come into compliance. Regulations - (1992) §54.1-411.B Effective - June 29, 1993

File Number 93-01209, L.W. Elliott, PE

Violation - Mr. Elliott's firm conducted a visual inspection on a foundation that did not reveal indications of major structural defects. Board Action - No sanction. Regulations - (1992) 11.11.A.3. Effective - February 3, 1994

File Number 93-01209, Randall J. Holmes, PE

Violation - Mr. Holmes conducted a visual inspection on a foundation that did not reveal indications of major structural defects. Board Action - $500 monetary penalty. Regulations - (1992) 11.11.A.3. Effective - February 3, 1994

File Number 93-01798, John L. Schneider, Jr., PE

Violation - Mr. Schneider performed and put to record a house location survey when not licensed as a land surveyor. Board Action - $500 monetary penalty; agrees to not engage in surveying without a proper license; and notify all affected clients of his improper conduct and provide proof of notification to the board. Regulations - (1992) §54.1-406.A; 5.10.A; 5.10.B.1-3; 5.10.C.1.2.a-n; 11.5.A.C; 11.6.D. Effective - April 12, 1994

File Number 93-00770, Joe T. Gollehon, LS

Violation - Mr. Gollehon's son surveyed adjoining properties for discrepancies in lot dimensions and Mr. Gollehon did not ensure that minimum standards were met. Board Action - $30.00 monetary penalty; $750.00 reimbursement for cost of investigation, court reporter and transcript; Mr. Gollehon must complete a boundary survey in accordance with the regulations and provide proof to the board. Regulations - (1992) 5.10.B.3; 5.10.C.1 and 5.10.C.2.a-n. Effective - May 26, 1994 Δ
